“The CFTC is proposing new rules and amendments to its existing regulations for futures commission merchants, swap execution facilities, designated contract markets, and derivatives clearing organizations.”

That line from the Federal Register filing opened the latest Doginal Dogs Space discussion on Monday. The room focused on how the new docket under RIN 3038-AF76 targets affiliate conflicts across FCMs, SEFs, DCMs, and DCOs rather than listing standards for any product.

Docket Details in Focus

The proposal covers 17 CFR Parts 1, 37, 38, and 39. It would bar an SRO or DSRO from serving as DSRO for its own affiliate FCM. It also calls for independent third-party surveillance of affiliate FCMs and new reporting-line and non-public information barriers. An FCM could elect NFA as its DSRO. The preamble counts 20 registered SEFs, 27 designated DCMs, 24 registered DCOs, about five with an affiliated clearing member, and about eight DCMs with affiliated market makers. Proposed sections 38.852 and 37.1201 lay out the core requirements.

Live Room Reaction

Numbers drove the conversation. Participants noted the October 5, 2026 comment deadline and the 91 FR 50926-50995 citation. The room tracked how the filing sits apart from the AF65 prediction-markets docket and from AF71, AF75, AF77, and AF78. David Chaboki (Shibo) and Christian Barker (Barkmeta / Bark) placed the October 5 date in the space ahead of any July 27 reference so listeners would separate AF76 from AF65. The discussion stayed on oversight mechanics and the separate comment window.

Market Snapshot

CoinGecko showed Bitcoin at 78674 dollars, up 1.79 percent. Ethereum traded at 2470.34 dollars, up 1.16 percent. XRP sat at 1.47 dollars, down 1.92 percent. SOL moved to 96.12 dollars, up 1.02 percent. DOGE printed 0.088962 dollars, down 3.91 percent. Majors posted modest gains while the regulatory filing drew attention.

Davis Polk and Federal Sources

The Davis Polk client update summarized the vertical integrity rules and the scope for FCMs, SEFs, DCMs, and DCOs. The federalregister.org entry confirmed the Proposed Rule status and the exact page range. Both sources aligned with the August 6 publication date and the single October 5 close.

Operator Lens

The move centers on leadership in self-regulatory oversight. The proposal gives market participants a defined path to elect NFA as DSRO and requires clear separation when affiliates are involved. The room treated the filing as an open NPRM, not a final rule, and kept the timeline focused on the comment period rather than implementation dates.

Next Steps

Industry input runs through October 5, 2026. The CFTC will review comments on the affiliate-conflict provisions before any further action. The docket remains distinct from product-listing proposals and other recent RFCs.
